Supreme Court Brings Clarity to Rivers State Political Crisis


In a landmark decision, Nigeria’s Supreme Court has finally resolved the long-standing political turmoil in Rivers State, putting an end to months of legal battles and power struggles. The court’s ruling, delivered on February 28, 2025, has clarified the status of the state’s lawmakers and firmly addressed Governor Siminalayi Fubara’s controversial actions.  


The Heart of the Conflict  

The crisis began when Governor Fubara decided to work with a three-member assembly led by Victor Oko-Jumbo, sidelining the 27-member group led by Speaker Martins Amaewhule. Fubara claimed that the Amaewhule group had defected from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC), making them illegitimate. However, the courts disagreed, ruling that Fubara’s actions were unconstitutional.  


Despite multiple court orders, including a Federal High Court ruling and an appeal court decision, Fubara continued to defy the judiciary. He even presented the 2025 budget to the Oko-Jumbo group, despite the 2024 budget presentation being declared illegal. The Supreme Court described Fubara’s actions as “despotic” and accused him of collapsing the state’s government to avoid impeachment.  


 The Supreme Court’s Verdict  

The apex court was unequivocal in its judgment. It declared that the Amaewhule-led assembly is the legitimate legislative body in Rivers State and the only group Fubara can legally work with. The court also criticized Fubara for undermining the state’s constitution and democratic processes. Justice Emmanuel Agim, who delivered the lead judgment, stated that Fubara’s actions were a “brazen subversion” of the state’s governance and the rule of law.  


The court further emphasized that the 27 lawmakers remain valid members of the assembly and cannot be prevented from performing their duties. It dismissed Fubara’s claims of defection as a “red herring” to justify his unconstitutional actions. The ruling effectively nullified any pending cases related to the crisis, including a Port Harcourt High Court case seeking to sack the 27 lawmakers.  


What This Means for Rivers State  

The Supreme Court’s decision brings much-needed clarity and stability to Rivers State. It reaffirms the importance of adhering to constitutional processes and respecting the rule of law. For Governor Fubara, the ruling is a stark reminder that no one is above the law, and political disagreements cannot justify undermining democratic institutions.
